The head of family law at Stewarts Law has returned refreshed from a sabbatical to New Zealand, and when Spear’s meets him he looks content after a decade of unmatched success at the top of family law.
Clients include City entrepreneurs, businessmen and ‘a sprinkling of well-known figures from media and the arts’, who value speed, confidentially, control over their own affairs and certainty, with assets often stretching into the hundreds of millions or even billions.
His clients’ needs? ‘Business people like clarity and certainty and are not encouraged when the court cannot even agree whether the family proceedings are “quintessentially private” [as said Mr Justice Mostyn] or should be held in open court, as Mr Justice Holman says. It’s rather like a modern day papal schism,’ he says.
That last comment is instructive. Stephen Foster is a renaissance man with a wide frame of reference, and he balances this with marked technical skill. ‘An enormously accomplished practitioner, Stephen is intelligent, well considered and a superbly tactical litigator,’ says one peer.
Foster sums up his ethos: ‘For me the satisfaction is ensuring that we achieve the best possible result for each and every case, whether the asset base is £5 billion or £5 million. It’s imperative that every client’s case is treated as if it’s the most important case that the department is dealing with.’
