While asset tracing used to be his bread and butter, Marks says those cases have become very uncommon as it becomes increasingly difficult for people to hide money with all the changes to money-laundering regulations. ‘I now deal with people who are obviously rich,’ he explains.
Cryptocurrencies are still an unknown quantity, though: ‘It’s going to be another way for shady types to hide their assets, and it’s going be a matter of whether you can prove he’s got the Bitcoin.’
Marks is adamant that mediation should be a mandatory first step for any divorcing
couple – and not just because his wife is chair of the Family Mediators Association.
‘I can hardly imagine a dispute which isn’t suitable for mediation,’ he says, advising couples to go directly – ‘and this won’t make me very popular’ – to a professional mediator rather than to a solicitor where there may be a conflict of interest.
