Statistics produced by the Ministry of Justice show that over the past five years there has been a doubling in the number of probate disputes being dealt with by the High Court. There are likely to be a number of reasons for this but high profile cases such as those involving the RSPCA and the estate of Sir Jimmy Savile, to name just two, provide clues for the increase.
Inherited Assets Look Like They Might Escape a 50-50 Divorce Split
London has, since around the turn of the millennium, attained the dubious status of ‘Divorce Capital of the World’. This is principally due to the introduction and development of radical new concepts in the law of financial provision, whereby the claimant’s award was no longer to be pegged at the ‘bottom line’ level of reasonable needs, but could in many cases extend to a full 50 per cent of the total assets.
